Application for International Patent Registration

A patent received from Turkish Patent Institute protects your utility model invention only within the borders of Turkey. A separate application has to be made for other countries for which protection is requested.
There are various ways for making trademark registration in abroad. These are as follows:
1- Individual application:
Filing individual applications before the offices of countries for which protection is requested and carrying out patent procedures for each country within the frame of regulation of relevant country.
2- Community application:
International or Territorial conventions and contract to which Turkey is also affiliated may be benefitted. The object of these conventions is to carry out some part or whole of application procedures before the office to which the union is affiliated and to decrease the costs.

– African Region Intellectual Property Organization (ARIPO)
– Gulf Cooperation Convention (GCC)
– Organisation Africaine de la Propriété Intellectuelle (OAPI)
Patent Cooperation Treaty (PCT)
The Patent Cooperation Treaty to which Turkey has been a party on 01 January 1996 has 148 member countries along with the membership of Saudi Arabia as the date of 03 August 2013. PCT system is basically divided into two part as 1. International process and 2. National process.
1. International process:
PCT application is making the application before of WIPO (World Intellectual Property Office) which is the authorized office and carrying out the survey and preexamination (not compulsory) procedures.
2. National process:
The national process is passed in the desired affiliated countries before expiry of 30 months since the date of application or priority if any and the procedures until the registration are carried out pursuant to the code of that country.
European Patent Convention (EP)
The European Patent Convention concerning to registration of European patents was signed on 5 October 1973 and came into force on 7 October 1977. The object of European patent application is to increase the cooperation between European countries in terms of protection of inventions and grant a patent valid in all affiliated countries and create a common patent code.
The protection is requested in all or selected countries among 38 affiliated countries within the scope of European Patent Organization to which Turkey had become a party on 01 November 2000 and which has 38 affiliated countries. EP system basically is divided into two parts such as 1. European patent process and 2. National process.
European Patent Process:
All procedures relevant to the European patent application (formal examination, research, publish, examination, registration decision and rejection) are carried out before the European Patent Office (EPO).
2. National Process:
The patent fascicle is filed in the affiliated countries for which protection is requested in due time since the registration decision is given for the European patent application and it is protected pursuant to the national codes of that country.
Eurasia Patent Convention (EURASIAN)
It came into force on 12 August 1995. It has a system similar to European Patent system. The affiliated countries are Turkmenistan, Azerbaijan, Belarus, Kazakhstan, Kyrgyzstan, Moldova, Russian Federation, Tajikistan and Armenia.
African Region Intellectual Property Organization (ARIPO)
It has a structure similar to European and Eurasia patents. The national phase is started before the affiliated countries by carrying out procedures before a single office. The affiliated countries are Botswana, Zambia, Ghana, Kenya, Lesotho, Malawi, Mozambique, Namibia, Sierra Leone, Somalia, Sudan, Swaziland, Tanzania, Uganda, Zambia, Liberia, Rwanda and Zimbabwe.
Gulf Cooperation Convention (GCC)
It has a structure similar to European and Eurasia patents. The national phase is started before the affiliated countries by carrying out procedures before a single office. The affiliated countries are United Arab Emirates, Bahrain, Qatar, Oman, Saudi Arabia and Kuwait. When requested, individual applications may be also done in these countries.
Organisation Africaine de la Propriété Intellectuelle (OAPI)
Its affiliated countries are Benin Republic, Chad, Burkina Faso, Ivory Coast, Gabon, Guinea Bisauni, Guinea, Equatorial Guinea, Mali, Mauritania, Niger, Senegal, Togo, Congo, Cameroon and Central African Republic. In OAPI application, whole of countries are automatically selected. Due to that there is no individual patent offices, acquiring protection in these countries is to file OAPI application or pass to national phase following PCT application.
